This Acceptable Use Policy (the “Policy”) is incorporated by reference into and forms a part of the Customer Terms of Service (the “Agreement”) between you, the customer (“you”) and LimeSpot Solutions Inc. and its affiliates (collectively, “LimeSpot”). This Policy sets forth certain terms and conditions upon which you may use the Products. Capitalized terms used and not otherwise defined in this Policy have the meanings ascribed to them in the Agreement.

Prohibited Content and Use

You are liable for any illegal or prohibited User Submitted Content that you upload or submit to the Account, including, for example, infringing, defamatory, or offensive materials. You may not, and hereby represent, warrant and covenant that you will not upload to the Account any User Submitted Content or otherwise use your Account or any of the Products in a manner that:

• is unlawful, harmful, threatening, tortious, defamatory, libelous, abusive, disparaging, pedophilic, pornographic, obscene, invasive of another’s privacy, hateful, or malicious;
• contains hate propaganda or promotes discrimination or violence against any people on account of their race, national origin, religion, age, gender, disability, or sexual orientation;is or could be harmful to minors; harasses or advocates harassment of another person;
• involves the transmission of “junk mail,” “chain letters,” or unsolicited mass mailing or “spamming” details of which is available on Email Sending Policy;promotes information that you know is false, misleading, or promotes illegal activities or conduct;
• is or promotes an illegal or unauthorized copy of another person’s work, such as providing pirated computer programs or links to them, or providing information to circumvent manufacture installed copy protect devices;provides material that exploits people under the age of 18 in a sexual or violent manner;
• provides instructional information about illegal activities such as making or buying illegal weapons, or providing or creating computer viruses;
• contains a software virus or any other code files or programs that are designed to or have the ability to interrupt, destroy, compromise, or otherwise limit the functionality of any computer software or hardware or telecommunications equipment whether owned by LimeSpot or any other party; or
• otherwise violates any local, state or provincial, national or other applicable law or regulation.

Prohibited Acts

In addition, you may not, in connection with your use of the Account or any of the Products:

• impersonate any person or entity, including a LimeSpot officer or employee, or falsely misrepresent your affiliation with LimeSpot or any other person or entity;
• forge headers or otherwise manipulate identifiers for the purpose of disguising the origin of any User Submitted Content posted or transmitted through or on the Account;
• upload or download any User Submitted Content that you do not have the right to upload or download;
• interfere with or disrupt the operation of the Products or any server or network involved with the operation of the Products including, but not limited to:
• monitoring or crawling of any of LimeSpot’s systems that impairs or disrupts the system being monitored or crawled;
• inundating a target with communication requests so that the target either cannot respond to legitimate traffic or responds so slowly that it becomes ineffective;
• orinterfering with the proper functioning of any system, including any deliberate attempt to overload a system by mail bombing, news bombing, broadcast attacks or other flooding techniques.
• ​access or use the Products or any system relating to the Products without permission including attempting to probe, scan or test the vulnerability of a system or to breach any security or authentication measures used by any system; or
• monitor data or traffic through the Products or any system relating to the Products without permission.

ANY ATTEMPT BY YOU TO DISRUPT OR INTERFERE WITH THE SERVICES INCLUDING UNDERMINING OR MANIPULATING THE LEGITIMATE OPERATION OF THE SERVICES IS A VIOLATION OF OUR POLICIES AND MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS.

Monitoring

We reserve the right, but do not assume any obligation, to investigate any violation of this Policy or the Agreement. Without limiting the foregoing, we may: ​Investigate violations of the Agreement or the misuse of the Products; or

​Remove or disable access to your Account, or any other agreement we have with you for the use of any of the Products or other products and services offered by LimeSpot or its affiliates

Responsibility for Your Conduct. You shall remain solely liable for the information you upload to or download from the Account. You agree to indemnify and hold harmless LimeSpot and its affiliates and the Licensor from any claim, action, demand, loss, or damages (including attorneys’ fees) made or incurred by any third party arising out of or relating to your conduct, your violation of this Agreement, or your violation of any rights of a third party.

Abuse. You acknowledge that any abuse of any kind, including but not limited to threats of abuse or retribution of any LimeSpot customer, LimeSpot employee or any other affiliate or representative of LimeSpot or the Licensor will result in the immediate termination of your Account and use of the Products.

Enforcement. LimeSpot or its affiliates may investigate any reported violation of this Agreement or complaints and take any appropriate action that it deems appropriate. Such action may include, but is not limited to, issuing warnings, suspension or termination of service. In order to comply with legitimate governmental requests, subpoenas, court orders or other disclosure orders, LimeSpot or its affiliates may access and disclose any information it considers necessary to comply with such requests, subpoenas or court orders, including, without limitation, user profile information (i.e. name, email address, etc.), IP addressing and traffic information, and usage history. LimeSpot’s and its affiliate’s rights to disclose any such information shall govern over any terms of LimeSpot’s Privacy Policy.

​Logos, Links, and Fair Use: Certain pages of the LimeSpot website may contain copyrighted material or trademarks, the use of which may not have been specifically authorized by the copyright or trademark owner. For example, LimeSpot uses images or screen shots of materials (which may be protected by copyright) produced by other organizations to demonstrate how to install LimeSpot products and/or services. LimeSpot also refers to names and products (which may be protected by trademark) owned by other organizations, for the purposes of identifying the product and how LimeSpot’s software and services may integrate with that product. In most cases LimeSpot does not have any affiliation with, and is not being endorsed or sponsored by, these other organizations. LimeSpot believes that its use of the copyright and trademarks of others this type of context qualifies as fair use under copyright and trademark laws. ​
